MODESTO — A woman crossing the street to her mailbox in rural Modesto was struck and killed by a driver from Patterson at about 2:45 p.m. Friday, Dec. 9.

Elsaree Duncan-Murray, 69, of Modesto, was walking south across Paradise Road near Hart Road when she stepped into the path of a 2004 Honda driven westbound by Chesney Vargas, 44, of Patterson, according to the California Highway Patrol.

It is too soon to know if charges will be filed in the case because it is early, said Highway Patrol Officer Bryce Disch said. Pedestrian versus car fatal accidents are a fairly rare occurrence, he said.

Neither alcohol nor drug use appears to be a factor, and the accident is still under investigation.
